DOT Corrections & Clarifications

Each year the Pipeline and Hazardous Materials Safety Administration (PHMSA) reviews the Hazardous Materials Regulations to identify and clarify any errors or unclear rules.  These amendments are not drastic by any means.  However, they should clarify any inconsistencies and/or typographical errors that could be mistakenly interpreted.  Some notable changes are below.

·         In CFR 49-171.8, the last sentence of the definition of “Hazardous Materials” was  amended to be consistent with other references to the definition throughout the Hazardous Materials Regulations.
·         In CFR 49-172.101, Special Provision B37 is erroneously applied to Column (7) for the Packing Group I entry of “Cyanide solutions, n.o.s.”  The Special Provision has been removed.  In addition, The proper shipping name for isomer entries for “Aminophenols” was changed from regular font to italics.  Words in italics are not required to be part of the proper shipping name, but may be used in addition to it.
·         In CFR 49-172.102, Special Provisions B37, B50, B60, and N72 are not assigned to any entries in the Hazardous Materials Table in CFR 49-172.101.  These references are being removed from this section.
·         In CFR 49-173.12, the unit conversion of 3 mils and 6 mils to inches was corrected from “0.12 inches” and “0.24 inches” to “0.003 inches” and “0.0006 inches” respectively.
·         In CFR 49-173.35, CFR 49-173.134, and CFR 49-178.503, there was some missing text, mistakenly added text, and slight typographical errors that were fixed.
·         In CFR 49-178-601, general requirements for testing of non-bulk packaging and packages prescriptions were not clear and references to paragraph (g)(3) for single packaging, and to (g)(4) for combination packaging were added for clarification.
